ازدواجی آبروریزی شادی کے بعد مرد کا اپنی بیوی یا بیوی کا اپنے شوہر کی مرضی کے بغیر مجامعت کرنے کو کہا جاتا ہے۔ یہ عمل خانگی تشدد اور جنسی زیادتی کی ایک قسم ہے۔ بیسویں صدی کے وسط میں جب خواتین کو بااختیار بنانے اور ان کے حقوق کے تحفظ کے نعرے بلند ہوئے تو اس ازدواجی آبروریزی کے خلاف آوازیں بھی اٹھنے لگیں، کیونکہ دنیا کے اکثر ممالک میں خواتین اس جنسی تشدد کا زیادہ شکار تھیں۔ گرچہ بہت سے ترقی یافتہ ملکوں میں قانوناً اس فعل کو قابل سزا جرم تسلیم کر لیا گیا ہے تاہم بعض ممالک میں ابھی تک اسے قابل سزا جرم نہیں سمجھا جاتا اور نہ ہی اس فعل کے لیے کوئی قانون بنایا گیا ہے۔

ازدواجی آبروریزی کو قابل سزا جرم تسلیم کرنے والے ممالک ترمیم

بیش تر مغربی ممالک میں جن میں انگلستان اور ریاستہائے متحدہ امریکا بھی شامل ہیں، ازدواجی آبروریزی یا اپنے شریک حیات سے اس کی مرضی کے خلاف جنسی تعلق قائم کرنا قابل سزا جرم ہے۔ یہ قانون اب دیگر ممالک میں بھی منظور ہو رہا ہے جن میں جنوبی کوریا قابل ذکر ہے۔[1]

ترقی پزیر ممالک میں ازدواجی آبروریزی کو قابل سزا جرم بنانے کی دشواری کا اندازہ بھارت کی مرکزی وزیر برائے خواتین و بہبودی اطفال منیکا گاندھی کے اس بیان سے ہوتا ہے کہ " عالمی سطح پر ازدواجی آبروریزی کا جو تصور ہے اسے بھارت میں نافذ نہیں کیا جا سکتا ہے کیونکہ یہاں متفرق عوامل مثلاﹰ پست تعلیمی سطح، ناخواندگی، غربت، سماجی رسوم و رواج، مذہبی عقائد اور معاشرے کی سوچ وغیرہ اس کی راہ میں حائل ہیں۔[42]

بھارت میں ازدواجی آبروریزی اور قانون ترمیم

بھارت میں ازدواجی آبروریزی کے واقعات عام ہیں جبکہ قانونی چارہ جوئی کے مواقع بہت کم ہیں۔ تعزیرات ہند کی دفعہ 375 کی رو سے شادی کے بعد جبری ہم بستری اسی وقت جرم ہو گی جب بیوی 15 سال سے کم ہو۔

بھارت میں ازدواجی آبروریزی سے متاثر خواتین قانون تحفظ نسواں از خانگی تشدد 2005ء (Protection of Women from Domestic Violence Act 2005 ۔(PWDVA)) کے تحت شکایت درج کر سکتی ہیں، یہ قانون 2006ء میں نافذ ہوا ہے۔ تاہم عدالتی نظام زن و شو کے درمیان میں عائلی حل ہی فراہم کرتا ہے۔[42]
